That's been a thread in discussions about registries and registrars since well before ICANN's creation. One of the goals of privatization was to remove the protections that NSI had historically enjoyed, to the detriment of others, by virtue of its realtionship to the government. Unlike NSI though, the new registries do not have a direct contractual relationship with the U.S., so I'm sure no one considered the fact that any of them would be so bold as to assert this "privilege." Look back through archives of the discussions leading to ICANN's creation and the creation of the registrar tier of competition.
