Verisign had to specifically disclaim "antitrust immunity" to get the DOC to sign off on the recent com/net/org agreements. See P.25 of Amendment 24. While Neulevel's argument seemed specious anyway, similar disclaimers for other forms of derivative immunity probably should have been included in all the registry contracts for good measure. One of the principal points of industry self-regulation has always been that the registries and registrars should be subject to market forces and private party lawsuits and not be propped up or protected by the U.S. government.
