In their official statement ICANN says:
The ultimate effect of the Court order is essentially the same as the ICANN
procedure that Mr. Auerbach refused to follow.
From which it seems reasonable to conclude that they don't see any need to
appeal. Assuming they really mean it, of course...

Right, given that they claim concern in the press release about expending limited resources, why spend even more if they've been vindicated? They probably wouldn't have to drag an appeal all the way to November, how long will it take a single individual to go through thousands of documents? Particularily if ICANN is using a, dare I say it, alternative filing system. -g
