If a US court wants to disable someone's .ORG name, shouldn't they ask PIR? PIR are the folks directly in control of the relevant zone file, and they're probably incorporated in the US as well. No need to bother ICANN that I can see...

An alternative, which is included in the order that e360insight has proposed to the court, would be to have Spamhaus' registrar, Tucows, remove the domain from the zone file. As an ICANN-accredited registrar, Tucows has adopted the UDRP, which states in paragraph 3(b): "3. Cancellations, Transfers, and Changes. We will cancel, transfer or otherwise make changes to domain name registrations under the following circumstances: . . . b. our receipt of an order from a court or arbitral tribunal, in each case of competent jurisdiction . . . ." This obligations applies upon notice to Tucows; e360insight does not even have to bring Tucows into the lawsuit.
