    If only various of the many ICANN critics could be as tenacious as Edward Hasbrouck in going after a specific topic, surely ICANN's house of cards would have long since toppled.

    I googled [google.ca] the adr.org website for references to ICANN and came up with zero even remotely related to independent review. There is no way to paint this complementarily: either Vint Cerf is lying or he is incompetent. -g

    People just do not get it. The spooks, academics,
    and legal players behind the whole Cerf Society
    house of cards (ICANN, ISOC, ARIN, etc.) are
    masters of Liability Deflection.

    All of the systems they have set up are designed to
    provide a continuous run-around. Most people get
    tired of the game and fade from the scene.

    If you have an issue with a Registry, the Registry
    will tell you ICANN makes them do what they do.
    ICANN claims the Registries operate on their own.
    Registrars are the same way, they claim the
    Registry calls the shots, yet they pay ICANN to
    endorse them as Registrars. It is ironic that the
    entire concept of a Registry and Registrar is
    totally artificial, and not needed. The Cerf
    Society just makes it all up as they go along.

    One of the main attributes of the Cerf Society is
    that they are never responsible or accountable
    for anything. Pay no attention to what they do
    with all the revenues. That is their private
    money they treat like donations. The Consensus
    Sham is one of their many outs, which they invoke
    to give people the old verbal kiss off (.VKO).
    They claim everything is based on "Community
    Consensus". It is a street-gang-like cop-out.

    They have built billion dollar personal fortunes
    on it, for decades. They really believe that they
    are "right" and a "success". They tell each other
    that every chance they get, but they never line
    up to be accountable or responsible.

    ICANN's next secret move is of course to deflect
    a lot of attention and liability to the new
    NeuStar conglomerate the insiders are building
    to serve ICANN. Watch the shell game as the .XXX
    liabilities are pushed off to New.Net and the
    new "community" ICANN is grooming. ICANN has
    plenty of funding and is not going to risk any
    of that. The new game (actually the old game also)
    is to control, grow, and deflect 99% of the
    legal liabilities to suckers in line ready to
    carry the ball, and pay ICANN for the honor of
    doing that.

    What happens when (not if) Verisign is handed
    a court order to cut-off connections to Registrars
    that are conspiring with Verisign and ICANN to
    violate the ACPA ?

    "The Anticybersquatting Consumer Protection Act is a federal law that took affect on November 29, 1999. This new domain name dispute law is intended to give trademark and service mark owners legal remedies against defendants who obtain domain names "in bad faith" that are identical or confusingly similar to a trademark or service mark. If a mark is a famous mark, the same remedies are available if the domain name is identical to, confusingly similar to or dilutive of the mark."

    What's the Quickest & Easiest Way for Domain Name Owner to Lose an ACPA Lawsuit?

    If the domain name owner, including a domain name owner that may not otherwise be liable under the ACPA, offers at any time to sell or transfer the domain name for value, most courts will find that the owner has acted in bad faith and if the other elements of the case are proven, the plaintiff will win.

    ICANN, the IETF and IAB Use the Same Run Arounds

    We have received your previous notes on draft-iab-idn-nextsteps-04 from the document editors.

    We have seen the intensive communication between you and the editors on the UTC review of an earlier version of the draft. We realize that certain technical issues you raised remained an issue in version 04 of the draft. Having reviewed those issues carefully, we remain convinced that much of the disparity of viewpoint stems from a difference in perceived intention for the document.

    As stated in the document's opening remarks, the goal of the document is simply and strictly to provide a survey of the issues that have been identified as impediments to deploying IDNs in the way that meets the end users' expectations, and provide action plans for how the IETF (and other organizations, like ICANN) can address those issues. A specific non-goal of this document is to evaluate each one of those issues.

    It would therefore be presumptuous for us to drop issues that have been raised by the community at large, whether or not there is an expectation they will turn out to be a non-issue. The evaluation and conclusion of these issues is to be reached by the consensus driven IETF processes. Some of the points UTC has flagged as "non issues" will therefore remain listed in the document.

    There are also some other issues where the IAB sees the UTC does not agree with the position stated in the document. Clearly, many individuals and organisations have different views on sensitive subjects like internationalization, and we have tried to be as neutral as possible. We reiterate that these are our positions, and we've done our best to identify them as such, even as we recognize this may mean the UTC disagrees with some of them.

    We are at a stage that the discussion should move out of the IAB and into the public. Further revising details in the document could cause further comments and further delays to publication and delay of the discussion and evaluations that should take place in the engineering and policy arena.

    As a practical matter, we want to appropriately acknowledge the contributers to this document, you being a valuable one of them. To avoid possible confusion on the level of support we plan to add the last sentence of what follows to the acknowledgments section of the document:

            The contributions to this report from members of the
            IAB-IDN ad hoc committee are gratefully acknowledged.
            In particular, this report does not claim to reflect the
            views either of the Unicode Consortium as a whole or particular
            participants in the work of the consortium.

    We hope you find this appropriate, too.

    Of course, we hope you and the UTC will continue to be active in the IETF and other fora during the discussions that are expected to follow on from this survey of issues.

    I guess someone should be out there tilting at
    windmills...

    But surely you can't be the only one?

    If ICANN is so unresponsive and recalcitrant, then
    where is the angry swarm of other complaintants? Has
    everyone else given up and resigned to the status quo,
    as dictated to them by ICANN?

    So ICANN swat away a few minor irritants, while either
    A) selling out to the big-money interests, or B) doing
    nothing for so long that other countries get fed up, and
    start running their own root. (Wouldn't THAT be fun!)

    Anyway, sooner or later people are going to realize that
    the small number of TLDs is an artifically-created
    shortage. When that occurs, they will naturally act to
    correct it. To the extent that ICANN attempts to impede
    that progress, they will be worked around and made
    irrelevant. This might happen in as little as a couple
    of years, or it might take another decade. But it will
    happen.

    The .NET Registry fees that ICANN wrote into their
    own contract (despite once claiming they would never
    do that) have to be spent or "donated".

    Vinton Cerf is lining up a wide range of cronies to
    fund with the "soft money". Don't expect to see any
    accounting on how the funds are allocated.

    ICANN Manipulates Board "Non-Elections"

    I wanted to announce my resignation from the Nominating Committee as a
    representative from the BC, and advise fellow councilors of my interest in
    standing for election to the vacant Board seat now open for nomination.

      In order to stand for election, I have advised the Nominating Committee
    that I am resigning [from the Nominating Committee]and have asked to be
    removed from the Nominating Committee list and activities.

    In order to be fully transparent, I advise the Council that I am disputing
    an interpretation by the General Counsel regarding my eligibility to stand
    for election due to the Nominating Committee service. I have filed an
    ombudsman's appeal and am preparing a Reconsideration Request. In my view, I
    am fully qualified, now that I have resigned from the Nominating committee
    to be a candidate for election. The General Counsel has disagreed with my
    eligibility status, thus my appeals through the ombudsman, and possibly
    Reconsideration.

    I don't mean to clog the Council list with this topic, since that would be
    inappropriate, but please do let me know of any questions you may have. If
    nominated and seconded, then I'll have a chance to campaign, like any other
    candidate. At this point, the purpose of this posting is informational.

    When the IANA Game hits the market, people will
    be able to start and run their own non-profit
    sham and save the world and travel around in real
    life on the money made from the game.

    What are ICANN insiders doing to prepare for the
    IANA Game ?

    Over dinner, Bill Manning mentioned that the DoC is doing a request for information on IANA. It was quite werid because I cannot find it on NTIA website. Anyway, the request for information can be found at FBO website instead. Particularly, note this "The Department of Commerce, National Telecommunications and Information Administration (DOC/NTIA) is exploring options for Contractor performance of three, interdependent technical Internet coordinating functions.".

    Not too sure what it means but my gut feeling says this is pretty significant.

    Btw, a couple of people gave me funny looks when I login to Warcraft. Speaking of which, you might be interested to check out some news on our guild: C|net and 1Up, both got Slashdotted. It's a really cool guild. Just a couple days ago, after a semi-successful run with some guildies, Joi whispered me: "You know the warrior in your group? It would be funny for you to know he is John Crain from ICANN." John and me know each another...we just didn't know each another in the game :-)
