John you are a very bitter individual. You mischaracterize the purpose behind ICANN's letter to Verisign. Registrars sign agreements, and those agreements should be adhered to by ALL registrars. Verisign does not get a free pass because they're the biggest or because they are located in VA and have lobbyists. At the same time, now that ICANN has come out swinging against Verisign, there should be a similarly strong letter sent to Joker, Namescout and other Whois offenders.

Doesn't the Redemption Grace Period take care of this hypothetical problem?
The Transfers Task Force advised (and the ICANN BOD agreed) that there should be no WLS until after the RGP takes effect. Therefore, if your name gets deleted because you don't respond to a bad Whois notice, you'll still have 30 days to get the name undeleted with the RGP before the WLS subscriber would get the name.

Too bad ICANN and the current flock of industry insiders are short sighted. They'll continue to neglect the system, allowing the sharks to feed. Then some Judge's or Senator's daughter will lose her ilovebarbie.com URL to a domain speculator, and things will change.
Perhaps ICANN, Verisign, and all of the registrars prefer legislation allowing domain registrants as long as five years delinquency before a domain name registration can be dropped for non-payment of renewal fees. Just like property taxes, you don't lose your property unless your delinquent for 5 consecutive years.

Richard Henderson wrote Dan Halloran and others at ICANN regarding ICANN accredited registrar YesNic over four months ago (with no action or even response to date). Some of their questionable activities have been publicized for months before that. Now comes an allegation that YesNic is shielding WHOIS information and offering to act as a broker to someone who wants the name. Even VeriSign isn't doing this SFAIK. So where is ICANN when it comes to dealing with longstanding complaints of multiple apparent breaches against a registar?
