The registrars are desperate ... they'll lose this suit.
The registrars don't really want the court's judgement on this ... the registrars desperately want to negotiate ... No one should care one iota about the registars, they shafted the public with the release of new TLDs (2001 .info and .biz).
WLS is good for the consumer, and not so good for hardcore speculators. The general Internet public welcomes WLS. The fact that Verisign administers WLS is the downside, but frankly, Directi, Galcomm, Domain Wizard, the current version of Snapnames, and Drop Wizard all suck donkey d-ck, from a consumer's point of view.

Newman & Newman's lawsuit against ICANN and Verisign ALSO mentions "John Does" just like the Verisign suit against ICANN.
But in this cause, it would seem to refer to any Registrars who promote WLS to consumers.
Remember the .biz lottery case? A bunch of Registrars got sued for participating in the lottery. They all had to hire legal counsel to protect themselves.
Any registrar that starts promoting WLS is fair game for Newman & Newman!

The current version of Snapnames sucks? Yeah, it does, but guess who's powering Verisign's WLS service. Snapnames! At least right now with competing services, I can put in an order for a domain and if they don't get it, I don't have to pay. With WLS, whether I get it or not, I'd have to pay and I have no choice.
