The creation of new generic tld is clearly harmful to existing registrations (otherwise the concept of defensive registration would not be so readily understood). There must be some benefit to opening new generic TLDs to justify the confusion and damage that will be created.
In my opinion there is more of a question of unfair competition than restraint of trade. As i am sure you are aware, restraint of trade can be determined legal in an instance where it is in the best public interest and the interest of certain parties, however I do not beleive that you have a case for restraint of trade in the first place.
As for icannwatch.web, in my opinion that (would be) domain in the hand of anyone other than the ones running this website would be an immitation of their good name. The benefit would draw from the goodwill already built here. Basically unfair competition. Forcing companies to make 'defensive' registrations is also unfair and of no use to the public.
My understanding is that the New TLDs have been a proof of concept and the results have not been good. Adding these TLD, in my opinion has been unfair and adding more is a bad idea. Three or more wrongs will not make a right. The fact that an unlimited number of TLDs can not be added and that some will threaten restraint of trade if they can not add what they want shows one more example as to why that it is a bad idea to add more.
We need stability in the DNS, having nothing to do with socialism but because of computer science.
