Hey Dan,
Don't expect me to support what I believe to be the totally untenable and unlawful 'rights' of trademark holders to domain names in Sunrise processes. The US Federal courts have already held that a trademark right does not support any right to a textually identical domain name (Washington Speakers Bureau, Inc. v. Leading Authorities Inc., 51 USPQ2d 1478, (E.D. Va. 1999)).
I am not supporting the superiority of a trademark claim to the dot.info name. I think that everyone on the planet should have an equal right to register any name - generic or trademarked - as a domain name and use it in any fair and uninfringing manner that they wish.
I am merely pointing out the inconsistency of Afilias' actions in developing a policy that ostensibly creates a right for all trademark holders to register 'their' name - unless it happens to be one that Afilias wants for itself. Then the policy is ignored and the applicant politely told to 'take a hike'.
