Most registrars to not use DNS servers to check availability of domains. They could use DNS servers and probably did back in the day, but using DNS servers results in output which is not valid because the DNS update is delayed from the registry's database by as much as 24 hours (for .com names currently). Many/most registrars now use the registry's RRP or EPP servers to perform name availibility checks, so I doubt they would be in violation of this patent.
