I appreciate the idea that auctions have been discussed before. But this is not an argument against auctions. Indeed, the great weight of experience in resource allocation favors auctions. The argument made by the IAHC, that a beauty-contest based selection of gTLD operators is "fair and equitable," has been discussed, both in the context of spectrum allocation and gTLD auctions. Frankly, the counterarguments are devastating.
First, there is absolutely no evidence that "beauty contest" procedures are fair. Indeed, the evidence is quite the opposite, that such procedures favor entrenched stakeholders with lobbying power.
Second, the notion that wealthy companies are favored in markets is, of course, true. But this is a feature of market-based economies generally. The post and the IAHC have offered no reasons for treating gTLDs differently.
"Been there, done that," is not an argument. "Fair and equitable" is not an argument. Simon Higgs post does not in any way advance the discussion of this important issue.Lawrence Solum
