    USA Goverment Relations Commerce and ICANN: "Dramatic change?"

    The Internet Governance Project analyzes the new ICANN-Commerce Department oversight arrangement. Renamed a Joint Project Agreement (JPA), it is a cosmetic response to the comments received by NTIA during its Notice of Inquiry in July 2006. The object seems to be to strengthen the public's perception that ICANN is relatively independent. But the relationship between the USG and ICANN is fundamentally unchanged. In one important respect, the JPA has actually increased direct US intervention. If the new agreement was a movie, it might be seen as the sequel to the .xxx domain veto exercised by the U.S. Commerce Department last year. This time, the target is Whois policy.

    As long as the USG controlls ICANN, and as long as President Bush is in the White House, we shouldn't be surprised that there is so much wrangling over such an obvious issue like WHOIS privacy. Anything with "privacy" in the description cannot get supported under this Administration. Of course, how they handle this issue has implications for handling other issues going forward and what ICANN can and cannot do on their own.
