Paul Stahura of eNom, Inc., wrote in to say that eNom has written a letter [MS Word, or .pdf]
"regarding Verisign's proposed wait-list-system (WLS).
It was originally submitted to the ICANN board and to a number of other people.
One person has subsequently inserted his comments (in Red) and I've replied
to those comments (in Blue).
I think the arguments presented on both sides are interesting (though
admitedly complex),
and since I believe the comments help to clarify some aspects of the letter,
I've requested that the letter be posted on ICANNWatch with the comments.

The letter offers to substantiate the following assertions:
1) ICANN must not advantage one registrar over another.
2) WLS as originally proposed by Verisign would advantage some registrars over others. Besides violating ICANN’s bylaws, it would be counter to the goals of the DOC since it would create an un-level playing field among competitive registrars.
3) ICANN attempted to fix this problem, which resulted in a WLS as currently proposed and passed by the ICANN board of directors.
4) The fix did not remove the benefit to some registrars over others, thus the WLS as currently approved by the ICANN board advantages some registrars more than others in the WLS market, and therefore in the domain name market.
5) The final WLS must have certain restrictions in order to provide fair competition in selling WLS, and hence registering names. I will explain what this restriction must be and why another restriction may not be preferable to ICANN.
Worth a read, although the debate with the unnamed commentator gets pretty rough in places...
