New gTLDs Sunrise Challenge Another EYE WASH.
posted by jon on Thursday December 20 2001, @03:50PM

SanjeevGoyal writes "W.I.P.O. has released the list of successful .info trademark challengers. To my surprise, WIPO has not been verifying trademark registrations with the appropriate country; the majority of challenges are false claims. Mr. Jeffrey E. Kubiak has successfully challenged (15) domains including etickets.info, jobs.info, gambling.info, america.info, trucks.info, tickets.info, travel.info, chatrooms.info, cars.info, blinds.info, franchise.info, golf.info, mortgage.info, gamble.info, homedecorating.info"

    and Mr.Jeff Davies has successfully challenged (23) domains on wide verity of subjects like hotel.info, florida.info, orlando.info, airline.info, flight.info, internet.info, cargo.info, auction.info, bank.info, medical.info, investment.info, legal.info, creditcard.info, fashion.info, vacation.info, immigration.info, retirement.info, usopen.info, usa.info, nursinghome.info, tennis.info, diabetes.info, cruise.info

And Others like Mr. Allen Threadgill (9), Simon Steinle (5), Raj Kosuri (3) got the domains on wide variety of trademarks.

I have received an assurance from Mr.Ram Mohan of Afilias that no successful challenger will go scot free. They all have to submit their Trademark Papers and Mr.Jeff Davis who got 23 domain in challenge admitted that he is wrong but he has taken the liberty under the rules of afilias Policy of sunrise.

And also Afilias says that they can challenge Sunrise booked domain any time in its life as they have liberty to do this under new rule of so called "challenge of last resort." So there is no time limit to challenge any sunrise domain anytime. GREAT.

I imagine they could challenge the new owner if the new owner doesn't have a trademark. -g

Why don't you write with your ID ? you are asking very much valid questions ? which everybody can ask in this regard.

As you know wipo is not confirming the TM from concerning countries as am through this process although I offered them the TM papers of business and even submitted to my registrar at the time of registration of the said domain and for your info the Business.info is further challenged and this time I have to submit my papers and surely you will see that I will get this domain for my client as you know we have got Tm on the same all the details are on website and you can confirm it from the Indian Trademark office , we have got not one but two trademarks on the BUSINESS as a texual mark in two different classes.

And further you all people are invited to challenge the business.info as am list concern about the challenge as I have the TM on same.
